Terms of Service

1. Scope
These terms apply to your use of the hexon.io website, Hexon software (Community and Business editions), and related resources (documentation, downloads, container images). They do not replace or supersede any separate agreement you may have with Hexon or an authorized partner.
- Community Edition users and Business Edition customers are governed by these terms and the applicable license.
- Enterprise customers operate under individual agreements that may include custom usage limits, SLAs, support terms, data processing addenda, and privacy amendments.
- Partner-distributed deployments (resold, integrated, or managed by an official Hexon partner) are governed by the partner’s own terms in addition to the applicable license. The partner is responsible for communicating those terms to you.
- Managed deployments where Hexon or a partner operates the gateway on your behalf are subject to a separate data processing agreement and, where applicable, a privacy amendment.
If there is a conflict between these terms and a signed agreement, the signed agreement prevails.
2. Software license
Hexon is commercially licensed software. All rights, title, and interest in the software — including source code, binaries, documentation, and associated materials — are owned by Hexon.
Access to the software is granted under the terms of the applicable license agreement:
- Community Edition is provided free of charge for evaluation, development, testing, and internal non-production purposes. Use in production environments or as part of a commercial service requires a Business or Enterprise license. Hexon reserves the right to grant exceptions at its sole discretion.
- Business Edition is available as a self-service commercial license for production use within defined usage limits (users, nodes, and sites). Business Edition includes all generally available product capabilities within the licensed usage limits. Usage beyond the licensed limits requires an upgrade to a higher Business tier or an Enterprise agreement. Contact hello@hexon.io for licensing.
- Enterprise customers receive a commercial license as part of an individual agreement, with custom usage limits, SLAs, support terms, and optional source code review access under appropriate confidentiality terms. While Hexon aims to make all features and security improvements generally available, enterprise agreements may include custom integrations or modules developed for the customer’s specific requirements.
- Partners receive distribution and integration rights as defined in their partner agreement.
Hexon may publish selected libraries and components as open source under their own licenses (e.g., MIT, Apache 2.0). These are governed exclusively by the license included in their respective repositories and are provided without warranty. Open source releases do not extend any rights to the core Hexon software.
No license is granted by implication, estoppel, or otherwise except as expressly set out in the applicable agreement.
3. Commercial licensing
Business Edition licenses include all generally available product capabilities within the defined usage tiers. Contact hello@hexon.io for licensing.

4. Social impact licensing
We believe good security infrastructure should be accessible beyond the enterprise.
Hexon offers discounted enterprise licensing — with or without support plans — to non-profit organizations, educational institutions, public research bodies, humanitarian agencies, organizations operating in developing economies, and other mission-driven institutions.
Eligibility is assessed on a case-by-case basis according to alignment with our founding principles: transparency, public benefit, and the belief that organizations serving the public good deserve the same infrastructure as those serving the enterprise. Hexon reserves the right to approve or deny social impact licensing requests at its sole discretion.

5. Your responsibilities
When using Hexon software, you are responsible for:
- Complying with applicable laws and regulations in your jurisdiction.
- Securing your deployment, including configuration, access credentials, and certificates.
- Any data processed by the gateway on your infrastructure — Hexon does not access, control, or process this data unless under a separate managed deployment agreement.
- Ensuring that your use does not infringe the rights of third parties.
You may not use the software for unlawful purposes or in a manner that interferes with the security, integrity, or availability of systems, networks, or services.
6. Intellectual property
All intellectual property in Hexon software — including source code, binaries, protocols, architecture, documentation, APIs, and algorithms — is owned by Hexon. No license to the software implies any transfer of ownership or rights beyond what is expressly granted.
Trademarks. The Hexon name, the Hexon logo, and associated marks are trademarks of Hexon. You may use them only for accurate attribution (e.g., “powered by Hexon”) and not in a way that suggests endorsement, affiliation, or origin without written permission.
Registrations. IANA Private Enterprise Number 64753 is registered to Hexon. SPIFFE trust domain identifiers issued by Hexon use this PEN.
Open source components. Where Hexon publishes libraries under open source licenses, copyright in those components is retained by Hexon. Contributions are accepted under the terms of the applicable license or a Contributor License Agreement where required.
7. No warranty
Hexon Community Edition, Business Edition, and any open source libraries published by Hexon are provided as is and as available, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
Hexon does not warrant that the software is free of defects, vulnerabilities, or errors, or that it will meet your specific requirements.
Enterprise and partner customers receive warranties only as expressly stated in their individual agreements. No other warranty is implied by marketing materials, documentation, or technical communications.
8. Limitation of liability
To the maximum extent permitted by law, Hexon shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the software or website.
In no event shall Hexon’s total aggregate liability exceed the amount paid by you for the software in the twelve months preceding the claim (or €0 if no fees were paid).
For Enterprise customers, liability terms are defined in the applicable agreement.
9. Export control
The software may be subject to export control laws and regulations, including those of Spain, the European Union, and other applicable jurisdictions. You agree to comply with all applicable export and trade regulations and not to export, re-export, or otherwise transfer the software to any country, entity, or person in violation of such laws.
10. Termination
Hexon may suspend or terminate access to downloads, services, or resources if these terms are violated. Upon termination, all rights granted under these terms cease immediately and you must discontinue use of the software unless otherwise permitted under a separate agreement.
11. Partner program
Official Hexon partners are authorized to distribute, integrate, or operate Hexon software under the terms of their partner agreement with Hexon. If you obtained Hexon through a partner:
- The partner may provide first-line support and maintain their own terms of service.
- Hexon’s obligations to you are limited to what is specified in the partner agreement unless you also hold a direct agreement with Hexon.
- Partner status may be verified at hexon.io/partners.
12. Changes
We may update these terms from time to time. Material changes will be posted on this page with an updated date. We will provide reasonable notice where practical. Continued use of the website or software after changes constitutes acceptance.
13. Governing law
These terms are governed by the laws of Spain. Any disputes arising from these terms shall be submitted to the courts of Barcelona.
14. Entire agreement
These terms, together with any applicable license agreement, constitute the entire agreement between you and Hexon regarding your use of the website and Hexon Community and Business editions. They supersede all prior or contemporaneous communications, proposals, and representations with respect to the subject matter herein.
15. Severability
If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
Corporate governance (informational)
Hexon Star, S.L. adheres to B Corp principles — balancing purpose and profit, and considering the impact of our decisions on employees, customers, community, and the environment.
Shareholders, investors, directors, advisors, and other company officials are subject to governance standards covering:
- Confidentiality of non-public information
- Conflict of interest disclosure
- Insider information restrictions
- Intellectual property assignment
- Fiduciary duty under the Spanish Capital Companies Act (Ley de Sociedades de Capital)
